Terms of Service

Welcome to StoryPix. By accessing or using our AI-powered story generation service (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. These Terms constitute a legally binding agreement between you and Cognivo Ltd ("StoryPix"). We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of any modified Terms.

To use StoryPix, you must: • Be at least 18 years of age • Have the legal capacity to enter into binding agreements • Not be prohibited from using the Service under applicable law • Provide accurate and complete registration information The Service is designed for parents and guardians to create content for children. You are responsible for any use of the Service through your account.

**Account Creation:** • You must provide a valid email address • You are responsible for maintaining account security • You must not share your account credentials • You must notify us immediately of unauthorized access **Account Responsibilities:** • You are responsible for all activities under your account • You must keep your contact information current • One account per person; multiple accounts may be terminated **Account Termination:** • You may delete your account at any time • We may suspend or terminate accounts that violate these Terms • Upon termination, your access to content may be revoked

**Credit System:** • Credits are required to use generation features • Credit costs vary by feature (story, image, voiceover, video) • Credits are non-transferable between accounts • Unused credits do not expire while your account is active **Free Tier:** • New accounts receive 300 free credits • Free credits are one-time and non-renewable **Subscriptions:** • Paid subscriptions provide monthly credit allocations • Subscriptions renew automatically unless cancelled • Price changes will be notified in advance **Payment Processing:** • Payments are processed securely by Stripe • You agree to pay all applicable fees and taxes • Failed payments may result in service suspension **7-Day Money-Back Guarantee:** • You may request a full refund within 7 days of your initial subscription purchase • Refund eligibility requires that you have used less than 20% of your allocated monthly credits • If you have used 20% or more of your credits, you are not eligible for a refund as you have substantially used the service • Refund requests must be submitted via email to hi@storypix.art • Approved refunds will be processed within 5-10 business days • This guarantee applies only to first-time subscription purchases, not renewals or credit top-ups • Free tier credits are not refundable

**Nature of AI Content:** • Stories, images, and voiceovers are generated by AI systems • Results may vary and are not guaranteed to match expectations • AI may occasionally produce unexpected or imperfect results **Content License:** • Free users: Personal, non-commercial use only • Paid subscribers: Commercial use license included • The license is non-exclusive and revocable upon Terms violation **Definition of Commercial Use:** "Commercial use" means any use that directly or indirectly generates revenue, including but not limited to: • Publishing or selling products containing generated content • Posting on platforms with advertising revenue • Paid services creating content for clients • Business promotion or marketing materials The following are considered personal use (no paid subscription required): • Sharing within family • Social media sharing without revenue • Non-profit educational purposes • Giving as personal gifts **Limitations:** • We do not guarantee AI content is free from errors • AI-generated images may have visual artifacts • Character consistency across images is not guaranteed • Voiceover quality may vary by language and content **No Ownership Claims:** • We do not claim ownership of AI-generated content • However, similar content may be generated for other users • AI outputs are not guaranteed to be unique

**Your Content:** • You retain ownership of content you create or upload • This includes story prompts, character descriptions, and uploaded images **License Grant:** • You grant us a license to use your content to provide the Service • This includes processing, storing, and displaying your content • This license ends when you delete your content or account **Content Requirements:** • Your content must not violate any laws • You must have rights to any content you upload • Content must be appropriate for a family-friendly service **Content Removal:** • We may remove content that violates these Terms • You can delete your content at any time • Deleted content may persist in backups for up to 30 days

**StoryPix IP:** • The Service, including software, design, and branding, is our property • You may not copy, modify, or distribute our intellectual property • "StoryPix" and our logo are trademarks **Third-Party Content:** • Do not use copyrighted material without permission • Do not create content that infringes others' intellectual property • Do not use celebrity likenesses or trademarked characters **DMCA Compliance:** • We respect intellectual property rights • We will respond to valid DMCA takedown notices • Repeat infringers may have accounts terminated **Reporting Infringement:** To report copyright infringement, contact: hi@storypix.art Include: description of copyrighted work, location of infringing material, your contact information, and a statement of good faith belief.

You may NOT use StoryPix to: **Harmful Content:** • Create content promoting violence or hatred • Generate sexually explicit or pornographic material • Create content that exploits or harms children • Produce content promoting illegal activities **Deceptive Practices:** • Impersonate others or create misleading content • Generate fake news or disinformation • Create phishing or scam content • Produce deepfakes without consent **Technical Abuse:** • Attempt to bypass usage limits or security measures • Use automated tools to access the Service (except approved APIs) • Interfere with the Service's operation • Reverse engineer or extract our systems **Commercial Misuse:** • Resell or redistribute generated content as a service • Use free tier credits for commercial purposes • Create content for competing services Violations may result in immediate account termination.

**AI Providers:** • We use Anthropic, Google, and MiniMax for AI features • Your use is subject to their acceptable use policies • We are not responsible for their service availability **Payment Processing:** • Stripe processes all payments • Stripe's terms apply to payment transactions **Links and Integrations:** • We may link to third-party websites • We do not endorse or control third-party content • Third-party terms and privacy policies apply **Service Availability:** • Third-party services may have outages • We are not liable for third-party service interruptions

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We specifically disclaim: • Warranties of merchantability or fitness for a particular purpose • Warranties that the Service will be uninterrupted or error-free • Warranties regarding AI output quality or accuracy • Warranties that content will meet your expectations No advice or information obtained from StoryPix creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow disclaimer of implied warranties, so some of the above may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: We shall not be liable for: • Indirect, incidental, special, or consequential damages • Loss of profits, data, or business opportunities • Damages arising from use or inability to use the Service • Damages from AI-generated content • Damages exceeding the amount you paid us in the past 12 months This limitation applies regardless of the legal theory (contract, tort, or otherwise). Some jurisdictions do not allow limitation of liability, so some of the above may not apply to you.

You agree to indemnify and hold harmless StoryPix, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Content you create or upload • Your negligent or wrongful conduct **Copyright and Intellectual Property Claims:** • If your input prompts, character descriptions, or uploaded content result in third-party copyright or trademark infringement claims against StoryPix, you agree to fully indemnify us for all damages, settlements, and legal costs • This includes claims arising from use of copyrighted characters, trademarked names, celebrity likenesses, or other protected intellectual property in your prompts • You represent that you have the right to use any names, descriptions, or reference materials you provide We reserve the right to assume exclusive defense of any matter subject to indemnification.

**Your Right to Terminate:** • You may delete your account at any time • Deletion will remove your access to the Service • Some content may be retained per our Privacy Policy **Our Right to Terminate:** • We may suspend or terminate accounts that violate these Terms • We may terminate for prolonged inactivity (12+ months) • We may discontinue the Service with reasonable notice **Effect of Termination:** • Your license to use the Service ends immediately • You remain liable for any prior violations • Provisions that should survive termination will survive

**Governing Law:** • These Terms are governed by the laws of England and Wales • Without regard to conflict of law principles **Dispute Resolution:** • Step 1: Contact us to resolve disputes amicably (30-day negotiation period) • Step 2: If unresolved, disputes shall be settled by binding arbitration • Arbitration shall be conducted in English under ICC or JAMS rules • Class actions and jury trials are waived to the extent permitted by law **Consumer Rights:** • Nothing in these Terms affects your statutory consumer rights • If you are a consumer in the EU/EEA, you may bring claims in your country of residence • For claims under £500, you may use your local small claims court **Time Limit:** • Claims must be brought within one (1) year of the cause of action

We may modify these Terms at any time: • Material changes will be notified via email or in-app notice • Changes take effect upon posting unless otherwise stated • Continued use after changes constitutes acceptance • If you disagree with changes, you must stop using the Service We will maintain an archive of previous Terms versions.
